1. Our Contract
1.1 These Terms and Conditions govern the supply of goods sold by Tropical Paradise Aquatics Unit 4, Boyatt Wood Shopping centre, Eastleigh, Hampshire SO50 4QP("we" and "us") to the customer ("you") and constitute the entire and only agreement between us in relation thereto.

1.2 All orders placed by you are on the basis of these Terms and Conditions and are subject to acceptance by us by delivery of the goods to you at which point a legally binding contract is constituted between us. The processing of your payment and acknowledgment of your order does not constitute legal acceptance of your order.

2. Price & Payment
2.1 The price payable for the goods you order is as set out on our web site at the time you place your order.

2.2 Occasionally an error may occur with our web site and goods may be incorrectly priced in which circumstances we will not be obliged to supply the goods at the incorrect price.

2.3 We must receive payment for the whole of the price of the goods you order, and any applicable charges for delivery, before your order can be processed.

3. Delivery
•    3.1 Dry Goods. Delivery times quoted are estimates only, and ‘Tropical Paradise’ shall not be liable for any delays caused except to the extent caused willfully or negligently by ‘Tropical Paradise’. However, unless we have agreed a longer period for delivery with you, we will either deliver goods and/or services within forty eight hours of you placing the order or we will let you know as soon as it will not be possible to meet this obligation.  If an item is out of stock, we will contact you within one working day to arrange an alternative date or a refund”.
•    3.2 Livestock. Orders are shipped on Tuesday, Wednesdays and Thursdays. Unless by special arrangement. Orders are shipped via different couriers depending on your location, but usually will be on a Pre twelve noon delivery. We reserve the right to cancel, refund any orders that are priced incorrectly or in an un-saleable condition. This sometimes can happen with livestock. We will of course contact you within twenty four hours should this happen. Should any problems occur during shipping please accept the parcel, even if there has been a delay. Do not refuse delivery. Any Dead On Arrival stock must be reported to us the same day of delivery. Photographic evidence will be required should we offer a credit. Dead On Arrival stock is classed as a death in transit, not a death X amount of days later. Should we offer a credit, the credit amount will be emailed to you for a future order. We are unable to ship livestock outside the UK.

You are liable for any re-delivery costs involved when you have not been available to receive delivery or have not collected or arranged re-delivery of an item from your local delivery depot.

4. Availability
While we endeavour to hold sufficient stock to meet all orders, if we have insufficient stock to supply or deliver the goods ordered within 7 days we will email you with a new proposed delivery date. If this is not acceptable, you may cancel your order.

5. Cancellation & Returns

You have the right to cancel any contract under either of the following conditions:
•    Within seven days from the date ‘Tropical Paradise’ sent you the Order Confirmation if ‘Tropical Paradise’ has contracted to supply services to you, provided that ‘Tropical Paradise’ has not started to provide those services before the expiry of the cancellation period.
•    The cancellation Request should be sent by e-mail to sales@tropicalparadise.co.uk and must state your name, a description of the goods or services concerned and the order number of the cancelled contract. Attaching the Order Confirmation ‘Tropical Paradise’ originally sent you would also assist us in processing your cancellation as quickly as possible.
•    Where ‘Tropical Paradise’ have supplied goods to you, you must take reasonable care of the goods in your possession pending their return to ‘Tropical Paradise’.
•    ‘Tropical Paradise’ will only accept the returned goods in their original packaging and which do not exhibit signs of wear or tear. Any use of the delivered goods beyond that necessary to inspect the goods on delivery will invalidate your right to cancel the contract.
•    You must return the goods to ‘Tropical Paradise’ by registered post or similar within five days (excluding Saturdays, Sundays or Bank Holidays) from the date of the Cancellation Notice.
•    You are responsible for the cost of returning the goods to ‘Tropical Paradise’ and the risk of damage to the goods in transit. If the goods are damaged in transit ‘Tropical Paradise’ reserves the right to refuse a refund and it will be your responsibility to seek compensation from the carrier.
Once ‘Tropical Paradise’ has received the returned goods and satisfied itself that you have complied with the above conditions it will send you confirmation by e-mail that the return of the goods has been accepted by ‘Tropical Paradise’ and will immediately make a refund of the contract price of the item (excluding any delivery costs) to your debit or credit card used to purchase the goods.


6. Liability
PLEASE READ THIS CLAUSE

6.1 If you have notified us of a problem with the goods within 30 days of delivery, we will (subject to clause 4) either make good any shortage or non-delivery; replace or repair any goods that are damaged or defective upon delivery; or refund to you the amount paid by you for the goods in question.

6.2 We shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions. Our liability to you shall not in any event include losses related to any business of yours, such as loss of profits or business interruption, neither will we be responsible to you for any other loss which is not a foreseeable consequence of us being in breach of these Terms and Conditions or our legal duties.

6.3 This does not affect your statutory rights if you are a consumer, nor is it intended to exclude our liability to you for fraudulent misrepresentation or for death or personal injury resulting from our negligence.

6.4 Goods are intended for use in the UK only and we cannot confirm that the goods comply with any laws, regulations or other standards applicable outside the UK. All goods are sold in accordance with the manufacturer’s specifications and are subject to any qualifications, representations or instructions contained in the documentation associated with the goods.

7. Age Requirement for Specific Goods
Where you place an order for age-restricted goods such as ___________, you confirm that you are over the age of 18 and that delivery will be accepted by a person over the age of 18. We reserve the right to cancel your order if we reasonably believe you are not legally entitled to order certain goods.

8. Force Majeure
We shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered hereunder that is caused by any event or circumstance beyond our reasonable control (Acts of God, fire, lightening, flood, or extremely severe weather, explosion, war, disorder, flood, industrial disputes (whether or not involving our employees), acts or omissions of Internet services providers or acts of local or central Government or other competent authorities.

9. General
If any part of these conditions is invalid, illegal or unenforceable (including any provision in which we exclude our liability to you) the validity, legality or enforceability of any other part of these conditions will not be affected. This contract shall be governed by and interpreted in accordance with English law.
